tax planning
Tax planning is important for both personal and commercial reasons. The
department advises on all aspects of taxation including estate planning to minimise
inheritance tax and capital gains tax issues. The department recognises that effective
saving of tax normally requires long term planning and should be reviewed on a regular
basis to take into account taxation changes as well as changes in personal family and
financial circumstances.
wills
All clients should make a will regardless of the value of their assets to ensure that
their estate passes as they wish. In the absence of a will an estate passes under the
statutory intestacy provisions which may not be appropriate. Making a will can provide
considered protection for family members and may also save on the costs of administering
the estate under the intestacy provisions. KJD offer a full will making service using
their specialist knowledge of property trusts and tax law.
administration of estates
The private client department provides advice and assistance to personal representatives
including applying for probate, dealing with inheritance tax issues including deeds of
variation and distributing the estate.
probate and trust disputes
KJDs dispute resolution department has experience in all aspects of contentious
trust and probate actions including claims under the Inheritance (Provision for Family and
Dependants) Act 1975, issues relating to the validity and construction of trust deeds,
trustee and executor disputes and claims for breach of trust and fiduciary duties. We act
for both beneficiaries and trustees including company and pension scheme trustees and
disaffected pension scheme members.
trusts
The formation and ongoing administration of trusts is an important aspect of the work
undertaken by the department. Trusts form an important part of estate planning, as well as
meeting the needs of clients particular circumstances. The department's experience extends
to offshore trusts and in house preparation.
enduring powers of attorney
Loss of mental capacity can be caused not just through mental illness but through an
accident or physical illness for example a stroke at any age. It is important that
individuals and business owners ensure that in the event that this happens someone can
carry on running the business and signing cheques on their behalf. This can be achieved by
an enduring power of attorney. The department offers full advice on powers of attorney
including the establishment of and the day to day administration under them.
living wills
When making a will and/or enduring power of attorney clients may also wish to consider
leaving directions as to their medical treatment in the event of serious or terminal
illness. The department can advise on how this can be dealt with.
pension trust administration
Pensions and provision for retirement are becoming increasingly important. The employment
unit has a specialist pensions team dealing with the technical aspects of setting up
pension schemes and the relevant documentation relating to it. The private client unit
deals with the day to day administration of such pension funds
charities
The department acts for substantial charitable foundations. Charity work includes dealing
with all matters from the establishment of a charity the day to day running of a charity,
the administration, trading subsidiaries and compliance with Charity Commission
requirements.
